These Terms of Service & Refund Policy govern purchases and use of advertising services provided through King Marketer and kingmarketer.com. By purchasing a traffic package, submitting campaign information, or authorizing campaign fulfillment, you agree to these terms.
1. Advertising Service
King Marketer provides paid advertising traffic and click-delivery services. A package represents the number and type of advertising clicks described at the time of purchase. Where applicable, King Marketer may deliver additional clicks above the purchased quantity at no additional charge.
King Marketer does not sell or guarantee leads, opt-ins, sales, customers, commissions, profits, earnings, or any other business result. Conversion performance depends on factors outside King Marketer’s control, including the customer’s offer, landing page, copy, pricing, follow-up, email system, sales process, market conditions, and audience response.
2. Customer Campaign Information and Authorization
Customers are responsible for providing accurate campaign information, including the purchase email address, promotional URL, selected package, and other requested campaign details. The customer must have the legal right to advertise the submitted URL, offer, product, or service.
When a customer submits campaign information and authorizes King Marketer to begin fulfillment, the customer expressly requests performance of the purchased advertising service. King Marketer may retain records of that authorization, including the submitted campaign information, acceptance date and time, purchase information, and technical records reasonably necessary to document the transaction and fulfillment.
3. Traffic Delivery and Tracking
Campaign delivery may be measured using King Marketer’s internal campaign records and third-party tracking systems. Tracking data may include campaign identifiers, click counts, delivery timestamps, traffic-source information, and related technical data.
Minor differences between tracking platforms can occur because systems may use different filtering, bot detection, cookie, browser, privacy, or counting methods. King Marketer will use its campaign records and applicable tracking records in good faith to determine fulfillment.
4. Customer Website and Landing Page
The customer is responsible for ensuring the submitted website or landing page is active, functional, mobile accessible, and able to receive traffic. King Marketer is not responsible for lost opportunities caused by downtime, broken links, slow pages, incorrect URLs supplied by the customer, disabled forms, autoresponder problems, hosting failures, or other customer-controlled technical issues.
If King Marketer becomes aware that a destination is unavailable or unsuitable for delivery, campaign fulfillment may be paused while the customer is contacted for corrected information.
5. Prohibited Campaigns
King Marketer may reject, pause, or cancel campaigns involving unlawful activity, deceptive or fraudulent claims, malware, phishing, hate or harassment, intellectual-property infringement, or other content King Marketer reasonably determines creates legal, security, deliverability, or reputational risk. If a campaign is rejected before fulfillment begins, the appropriate unused amount will be refunded unless the transaction itself is fraudulent or otherwise subject to legal restriction.
6. Cancellations and Refunds
Before fulfillment begins: A customer may contact King Marketer to request cancellation. If traffic delivery has not begun and King Marketer approves the cancellation, the order may be refunded.
After fulfillment begins: Advertising services and traffic already delivered are non-refundable, except where required by applicable law. If a campaign is partially delivered and King Marketer agrees that the remaining service cannot be completed, King Marketer may provide replacement traffic, resume fulfillment, or refund the appropriate undelivered portion.
Completed campaigns: A completed click-delivery service is not refundable merely because the campaign did not produce the number of leads, opt-ins, sales, commissions, or earnings the customer hoped to achieve. Those outcomes are not part of the guaranteed service.
Nothing in this policy limits any non-waivable consumer rights or remedies available under applicable law.
7. Payment Disputes and Chargebacks
If a customer has a concern about an order, the customer should contact King Marketer promptly so the issue can be reviewed. Filing a payment dispute does not change whether advertising services were authorized or delivered.
When responding to a payment dispute or chargeback, King Marketer may provide the payment processor or financial institution with relevant transaction and fulfillment evidence, including the order information, customer-submitted campaign details, authorization records, applicable terms, correspondence, campaign status, tracking reports, click-delivery records, and completion records.
8. Campaign Scheduling
Requested start dates are preferences unless King Marketer expressly confirms a guaranteed date in writing. Delivery timing can vary based on campaign review, traffic availability, customer response time, technical issues, and other operational factors. King Marketer may pause a campaign when reasonably necessary to investigate quality, compliance, tracking, or destination-page issues.
9. No Earnings or Performance Guarantee
Advertising involves risk. Testimonials, examples, case studies, statistics, or previous campaign results are not promises that another customer will receive the same result. Customers are responsible for evaluating their own offer and business decisions.
10. Limitation of Liability
To the maximum extent permitted by applicable law, King Marketer will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from a campaign, website performance, customer conversion results, or third-party services. To the extent liability cannot lawfully be excluded, King Marketer’s aggregate liability relating to a particular advertising order will not exceed the amount the customer actually paid King Marketer for that order, except where applicable law requires otherwise.
11. Privacy and Records
Information submitted in connection with an order is handled in accordance with King Marketer’s Privacy Policy. King Marketer may retain transaction, authorization, campaign, tracking, support, and fulfillment records for legitimate business purposes, including customer service, accounting, fraud prevention, legal compliance, and payment-dispute documentation.
12. Changes to These Terms
King Marketer may update these terms from time to time. The version applicable to an order is generally the version presented or in effect when the customer purchases and authorizes the service, subject to changes required by law.
13. Governing Law
These terms are governed by applicable United States federal law and the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent another jurisdiction’s non-waivable law applies.
