These Terms & Conditions govern purchases and use of digital marketing services provided by King Marketer through kingmarketer.com. By purchasing a service, submitting onboarding information, or authorizing work to begin, you agree to these terms.
1. Services
King Marketer provides one-time digital marketing services such as campaign reviews, strategy recommendations, tracking setup or review, landing-page recommendations or approved edits, email follow-up setup, implementation support, optimization reviews, and performance reporting. The specific deliverables included in your purchase are the deliverables shown for that package at the time of purchase.
2. One Package Per Order
Marketing Starter, Campaign Builder, and Marketing Accelerator are separate service packages. Only one of these packages may be purchased in the cart at a time. If you later decide you need a different level of service, contact King Marketer so the appropriate next step can be determined.
3. Customer Information and Access
You are responsible for providing accurate information needed to complete the service, including your business information, offer, website or landing-page URLs, campaign goals, and requested onboarding details. When hands-on work requires access to a tool or account, you may be asked to authorize access or provide the information needed for approved work. You remain responsible for the accuracy, legality, and ownership rights of the materials and accounts you provide.
4. Scope of Work and Revisions
King Marketer will provide the work described in the purchased package. Requests outside the stated package scope may require an additional service, separate fee, or written approval. Recommendations and implementation assistance are based on the information available at the time the work is performed.
5. No Guaranteed Marketing Results
King Marketer does not guarantee leads, sales, revenue, profit, conversion rates, rankings, commissions, audience growth, or any other specific business result. Marketing performance depends on many factors outside King Marketer’s control, including the customer’s offer, pricing, audience, website, follow-up, competition, platform policies, market conditions, and customer decisions.
6. Third-Party Platforms
Some services may involve third-party platforms, software, email systems, analytics tools, website services, payment processors, or advertising platforms. King Marketer does not control those third parties and is not responsible for outages, policy changes, account restrictions, fees, data loss, or other events caused by third-party services.
7. Payment
Prices are shown before purchase. Payment is due at checkout unless otherwise agreed in writing. Payments may be handled by third-party payment providers made available through the checkout process. King Marketer does not require customers to send full payment-card information by email or through the onboarding form.
8. Cancellations and Refunds
Cancellation and refund requests are governed by the Refund & Cancellation Policy in effect at the time of purchase. In general, work already completed or substantially performed may be non-refundable except where applicable law requires otherwise.
9. Payment Disputes
If you believe there is a problem with a purchase, contact King Marketer promptly so the matter can be reviewed. When responding to a payment dispute, King Marketer may provide the applicable payment provider or financial institution with relevant transaction records, accepted terms, onboarding information, correspondence, work records, and evidence of deliverables.
10. Customer Responsibilities
You are responsible for reviewing deliverables and recommendations before using them, maintaining backups of important website or account information, complying with laws and platform rules applicable to your business, and making final business decisions about your marketing.
11. Intellectual Property
Upon full payment, you may use the custom deliverables created specifically for your purchased service for your own business. King Marketer retains ownership of pre-existing methods, templates, processes, know-how, and materials not created exclusively for the customer unless otherwise agreed in writing.
12. Limitation of Liability
To the maximum extent permitted by applicable law, King Marketer will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from marketing performance, customer business decisions, website or account issues, or third-party services. To the extent liability cannot lawfully be excluded, King Marketer’s aggregate liability relating to a particular service will not exceed the amount actually paid to King Marketer for that service, except where applicable law requires otherwise.
13. Privacy and Records
Information submitted in connection with a purchase or service is handled in accordance with King Marketer’s Privacy Policy. King Marketer may retain transaction, onboarding, support, authorization, and work records for legitimate business purposes, including customer service, accounting, fraud prevention, legal compliance, and dispute documentation.
14. Changes to These Terms
King Marketer may update these terms as the business, services, technology, or legal requirements change. The version applicable to a purchase is generally the version in effect when the purchase is made, subject to changes required by law.
15. Governing Law
These terms are governed by applicable United States federal law and the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent another jurisdiction’s non-waivable law applies.
